1) Who we are and what this is
- Spiral Moon Media Group, a wholly owned subsidiary of Spiral Moon Family Circle, a 501 (c)3 non-profit located in Michigan (“Spiral Moon,” “we,” “us,” “our”) operates the social platform at https://social.spiralmoon.org (the “Service”).

- If you do not agree, do not use the Service.
- If you use the Service on behalf of an organization, you represent you are authorized to bind that organization to these Terms.
3) Eligibility

- You are responsible for complying with local laws, including laws governing online content, privacy, and e‑commerce.
- We may disable or remove accounts that we learn are used by persons under 16.
4) Accounts, security, and identity
- Provide accurate information and keep it current. Craft names and pseudonyms are allowed.
- Impersonation or misleading identities (including claiming to be another real person, organization, or deity) is prohibited.
- You are responsible for your account and safeguarding your login credentials. Notify us immediately of any unauthorized use.
5) Name policy (craft names and verification)
- Craft names and religious/magical names are welcome. You may use a pseudonym publicly for safety and spiritual reasons.
- No impersonation of individuals, entities, or traditions. Parody/satire must be clearly labeled and must not create a risk of confusion.
- Verification: We may offer optional “verified” labels for organizations, clergy, artists, and creators. Verification does not imply endorsement.
- Legal compliance requests: We may request your legal name and contact information privately for legal compliance (e.g., DMCA counter‑notices, law enforcement requests, paid services, or marketplace disputes). We treat this information as confidential and will not display it publicly without your consent, except as required by law.
6) Community standards (Pagan‑centered conduct)
We are a Pagan‑centered space. All users must follow these standards:
- Respect for paths and traditions: No harassment, hate speech, or derogatory content targeting Pagans, witches, polytheists, heathens, occultists, or any religious/spiritual paths, including Abrahamic, Indigenous, Afro‑diasporic, and other traditions. Interfaith dialogue is welcome; proselytizing that demeans others is not.
- No bigotry or harassment: Prohibited content includes racism, antisemitism, Islamophobia, anti‑Pagan bias, misogyny, homophobia, transphobia, ableism, casteism, or attacks on protected characteristics. Also prohibited: doxxing, stalking, targeted harassment, or incitement to violence.
- Ritual and magical content: Discussion of ritual, spellwork, divination, and occult study is allowed. However:
- Do not solicit or coordinate real‑world harm, curses, or hexes targeting identifiable individuals or groups.
- No claims that promise guaranteed outcomes.
- Magical, divinatory, or astrological content is for entertainment, educational, community, or spiritual purposes only and is not a substitute for professional advice.
- Consent and privacy in sacred contexts:
- Do not share private coven materials, initiation oaths, or closed‑tradition teachings without clear, documented permission.
- Obtain consent from all identifiable participants before posting ritual photos, videos, or recordings.
- Safety and wellbeing:
- Do not provide instructions that could foreseeably cause harm (e.g., unsafe fire use, toxic or illegal substances, medical misinformation).
- Health, legal, or financial topics must include clear disclaimers; do not present spiritual practices as medical, legal, or financial advice.
- Nudity and sexual content (ritual/art context allowed):
- Non‑sexual, artistic, or ritual nudity is allowed with clear content warnings and, where available, age‑gating or sensitivity settings. Group owners may adopt stricter rules.
- Absolutely no minors in any context involving nudity or sexual content. Do not post images of persons under 18 in revealing or sexualized contexts. CSAM is forbidden and will be reported to authorities.
- No explicit sexual content or pornography.
- Commercial activity:
- Selling or trading illegal items (e.g., controlled substances, restricted animal parts) is prohibited.
- Listings for readings or spiritual services must be honest, lawful, and include disclaimers that outcomes are not guaranteed and that services are not professional medical, legal, or financial advice.
- Comply with all applicable e‑commerce, consumer, and tax laws.
- Intellectual property and cultural respect:
- Do not post content you do not have rights to share. Credit sources when required.
- Respect closed practices and living traditions. Critique is allowed; exploitation and misrepresentation are not.
- AI, bots, and automation:
- Label AI‑generated content where confusion could occur.
- Do not use bots to spam, scrape, or manipulate the Service.
7) Your content and license to Spiral Moon
- You retain ownership of content you submit.
- You grant Spiral Moon a worldwide, non‑exclusive, royalty‑free, transferable, and sublicensable license to host, store, reproduce, modify (e.g., formatting and compression), publish, display, perform, translate, and distribute your content for operating, improving, and promoting the Service.
- You represent and warrant you have all rights necessary to grant this license and that your content complies with these Terms.
8) Prohibited uses
You agree not to:
- Violate laws or regulations, including sanctions/export laws.
- Infringe IP rights or rights of publicity/privacy.
- Upload malware, perform security attacks, or attempt to access non‑public areas.
- Interfere with the Service’s normal operation, including scraping without permission.
- Use the Service to solicit or commit violence or real‑world harm.
- Post deceptive, fraudulent, or impersonation content.
- Post medical, legal, or financial advice as if you are a licensed professional when you are not.
9) Moderation, enforcement, and appeals
- Our approach: We aim to protect community safety and our Pagan‑centered mission while allowing robust, good‑faith discussion and art.
- Possible actions: We may remove or restrict content, limit functionality, add warning screens, age‑restrict content, or suspend/terminate accounts that violate these Terms or our Community Guidelines. We may also require edits or context labels.
- Off‑platform conduct: We may act at our discretion to protect community safety for behavior outside the Service that poses a credible risk to users.
- Notice: When feasible, we will notify you of moderation actions and provide a basic reason (e.g., rule violated, post link).
- Appeals window: You may appeal within 30 days of the action by contacting media@spiralmoon.net and including your username, a link or description of the content/action, and your reasons for appeal.
- Appeal review: We aim to review appeals within 14 days, but timing is not guaranteed. We may uphold, modify, or reverse actions. Repeated or abusive appeals may be declined.
- Evidence handling: We may preserve and review content and metadata relevant to moderation decisions and appeals. We may request additional information from you.
- No formal workflow (for now): We do not currently maintain a published moderation workflow and may update our processes as we grow. We will strive for consistency and fairness and may publish transparency reports as described below.
10) Reporting and safety
- Report violations via in‑app tools or at media@spiralmoon.net.
- For urgent threats of harm, contact local authorities first. We may cooperate with law enforcement when legally required or when we believe it is necessary to prevent harm.
11) Enforcement transparency reports
- We plan to publish periodic transparency reports (e.g., semiannually or annually) that may include:
- Counts of content removals, warning labels, age‑gated posts, and account actions by category.
- Appeal volumes and outcomes.
- Response times for reports and appeals (aggregated).
- Volume of legally binding requests (e.g., DMCA notices, court orders) and our responses, where permitted by law.
- Reports will present aggregated, privacy‑respecting data and may exclude sensitive details or items restricted by law or safety considerations. We may change the reporting format or cadence at our discretion.
12) Marketplace terms (community buy/sell)
- Platform role: The Service provides spaces (e.g., Groups, Pages, or Threads) where users may list items or services. Spiral Moon is not a party to transactions, does not act as broker, escrow, auctioneer, or guarantor, and does not charge platform fees for listings or sales.
- Buy/sell at your own risk: Transactions are solely between buyers and sellers. You assume all risks, including quality, description accuracy, shipping, delivery, refunds, chargebacks, and compliance with law.
- Group governance and disputes: If sales occur inside a Group, the Group Admin(s) set and enforce local rules. Disputes about transactions and group‑specific rules are handled by that Group’s Admin(s). Spiral Moon may act on rule violations platform‑wide but is not obligated to adjudicate individual transaction disputes.
- Prohibited and restricted items (non‑exhaustive):
- Illegal items, stolen goods, counterfeit items.
- Controlled substances, drug paraphernalia, weapons where prohibited by law.
- Restricted wildlife or animal parts (e.g., items barred by CITES, federal/state law).
- Human remains or body parts, except clearly lawful items (e.g., ethically sourced educational specimens where legal) and only with explicit group permission.
- Items that promote hate or violence.
- Adult items must not be sold to or depicted with minors and must comply with applicable laws.
- Listings and claims:
- Be accurate and honest in titles, descriptions, and photos. Do not guarantee outcomes for spiritual services.
- Clearly disclose condition, materials (e.g., herbs, stones), size, price, shipping costs, and any risks (e.g., allergens).
- Comply with labeling and safety laws (e.g., candles, cosmetics, botanicals).
- Payments and taxes:
- Arrange payment and shipping off‑platform through lawful methods. We do not process payments and are not responsible for payment disputes.
- You are responsible for taxes, duties, and compliance obligations related to your sales.
- Minors:
- Users under 18 may not buy or sell adult items or services. Do not target minors for any commercial offering.
- Remedies:
- Group Admins may remove listings, restrict sellers/buyers, and set additional group rules. Spiral Moon may take platform‑wide enforcement actions for violations of these Terms.
- Repeated or severe violations may result in account suspension or termination.
13) Advertising and sponsored content
- Labeling: Ads, paid promotions, affiliate links, gifts, or sponsorships must be clearly disclosed and conspicuous (e.g., “Advertisement,” “Sponsored,” #ad, #sponsored) in accordance with FTC Endorsement Guides and applicable law.
- Accuracy and claims: Advertisers and creators are responsible for truthful, non‑misleading content. Substantiate objective claims. Health, legal, or financial claims require appropriate disclaimers and must not present spiritual practices as professional advice or guaranteed outcomes.
- Restricted categories: We may prohibit or limit ads for illegal products/services, hate or extremist content, explicit sexual content, adult services, predatory lending, weapons, unsafe health products, and other categories at our discretion.
- Targeting and minors: Do not target ads to users you know or should know are under 18 for adult content or regulated products/services.
- Placement and volume: We do not guarantee impressions, reach, or placement. We may label, restrict, or remove ads that conflict with our mission or policies.
- Third parties: Ads may link to third‑party sites. We do not control or endorse third‑party content and are not responsible for their practices.

- Counter‑notification: If your content is removed due to a DMCA notice, you may file a counter‑notification as allowed by law. By law, counter‑notices must include your legal name, address, phone, and consent to the jurisdiction of a U.S. federal court. We may forward your counter‑notice to the claimant.
15) Paid features, subscriptions, and refunds [if applicable]
- If we offer paid features, we will disclose pricing, billing periods, renewal terms, and cancellation procedures at purchase.
- Unless stated otherwise, subscriptions renew automatically until you cancel.
- Except where required by law, fees are non‑refundable once the billing period starts.
- We may change pricing upon notice effective in your next billing cycle.
16) Third‑party services and links
- The Service may contain links or integrations to third‑party services. We do not control or endorse them and are not responsible for their content or practices.
- Your use of third‑party services is at your own risk and subject to their terms and policies.
17) Disclaimers
- Spiritual and metaphysical content: The Service hosts user‑generated spiritual, ritual, divinatory, astrological, and magical content for community, educational, and entertainment purposes only. No outcomes are guaranteed.

18) Limitation of liability
- To the maximum extent permitted by law, Spiral Moon and its affiliates, officers, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

19) Indemnification
- You agree to defend, indemnify, and hold harmless Spiral Moon and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal and accounting fees) arising out of or in any way connected with your content, your use of the Service (including marketplace activity and advertising), or your violation of these Terms.
20) Termination
- You may stop using the Service at any time and, where available, delete your account.
- We may suspend or terminate your access at any time, with or without notice, for any reason, including if we reasonably believe you have violated these Terms or pose a risk to the community.

23) In‑person meetups and events
- Users may organize or advertise events. We do not supervise or control events unless expressly stated.
- By attending or hosting events found through the Service, you accept all risks. We are not responsible for personal injury, property damage, or other harm arising from events, except where required by law.
24) Dispute resolution, governing law, and venue
- Informal resolution: Before filing a formal claim, you agree to try to resolve the dispute by emailing media@spiralmoon.net with a description of your claim. If we cannot resolve it within 30 days, either party may proceed.
- Governing law: These Terms and any disputes arising out of or relating to them or the Service are governed by the laws of the State of Michigan, without regard to conflict‑of‑laws principles.
- Venue and jurisdiction: You consent to the exclusive jurisdiction and venue of the state and federal courts located in Oakland County, Michigan, for all claims not subject to small‑claims procedures. You waive objections to inconvenient forum.
- Small claims: Either party may bring an individual action in small‑claims court in Michigan, if permitted by that court’s rules.
